Article 1: Fields of application

These General Conditions of Sale (known as «GTC») apply, without restriction or reservation, to all sales concluded by the Seller with professional buyers («Customers or the Customer»), wishing to acquire the products offered for sale by the Seller on the site https://pro.oraije.com/. The Products offered for sale on the site are as follows:

• Women’s ready-to-wear from Cindy. H, a jeans brand.

The main characteristics of the products, including specifications, illustrations and indications of dimensions or capacity of the products, are presented on the site https://pro.oraije.com/, which the customer is required to read before ordering.

The choice and purchase of a product is the sole responsibility of the Customer.

Product offers are within the limits of available stocks, as specified when placing the order.

These T&Cs are available at any time on https://pro.oraije.com/ and will prevail over any other document.

The Customer declares to have read and accepted these GTCS by ticking the box provided for this purpose before the implementation of the online ordering procedure on https://pro.oraije.com/ .

Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of all transactions concluded with the Customer.

The products featured on https://pro.oraije.com/ are available for sale in the following territories:

Germany, Austria, Belgium, United States, Metropolitan France, Italy, Luxembourg, Portugal and the United Kingdom.

In case of an order to a country other than metropolitan France, the Customer is the importer of the product or products concerned.

The Customer declares to have read and accepted these GTCS by ticking the box provided for this purpose before the implementation of the online ordering procedure on https://pro.oraije.com/ .

For all products shipped outside the European Union and DOM-TOM, the price will be calculated without tax automatically on the invoice.

Customs or other local taxes or import duties or state taxes may be payable. They will be at the expense and are the sole responsibility of the Customer.

Article 2: Prices

The Products are provided at the rates in effect on https://pro.oraije.com/, when the Seller registers the order.

Prices are expressed in Euros, HT and TTC.

The rates take into account any discounts that would be granted by the Seller on the site https://pro.oraije.com/.

These rates are firm and not revisable during their period of validity but the Seller reserves the right, outside the period of validity, to change the prices at any time.

The prices do not include the costs of processing, shipping, transport and delivery, which are charged in addition, under the conditions indicated on the site and calculated before placing the order.

The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.

An invoice is drawn up by the Seller and delivered to the Customer upon delivery of the Products ordered.

Article 3: Orders

It is up to the Customer to select on the site https://pro.oraije.com/ the Products he wishes to order.

The Customer can then put items in the shopping cart, modify and delete them.

Product offers are valid as long as they are visible on the site, within the limit of available stocks.

The sale will only be considered valid after full payment of the price. It is the Customer’s responsibility to check the accuracy of the order and report any errors immediately.

Any order placed on https://pro.oraije.com/ constitutes the formation of a remote contract between the Customer and the Seller.

The Seller reserves the right to cancel any order if the products ordered by the Customer are out of stock.

The Seller also reserves the right to cancel or refuse any order of a Customer with whom there is a dispute relating to the payment of a previous order.

The Customer can follow the evolution of his order on the site and contact the Seller at any time by mail and by phone.

Article 3 bis: Customer area - Account

In order to place an order, the Customer is asked to create an account (personal space).

To do this, he must register by filling out the form that will be proposed to him at the time of his order and undertakes to provide sincere and accurate information concerning his marital status and contact details, including his email address and telephone number.

The Customer is responsible for updating the information provided. It is specified to him that he can modify them by logging into his account.

To access his personal space and order history, the Customer must identify himself using his username and password which will be communicated to him after his registration and which are strictly personal. As such, the Client shall refrain from any disclosure. Otherwise, it will remain solely responsible for the use made of it.

The Customer may also request his unsubscription by going to the dedicated page on his personal space or by sending an email to oraije.paris@gmail.com. This will be effective within a reasonable time.

In case of non-compliance with the general conditions of sale and/ or use, the site https://pro.oraije.com/ will have the possibility to suspend or close the account of a customer after formal notice sent electronically and remained without effect.

Any deletion of account, whatever the reason, results in the deletion of all personal information of the Customer.

Any event due to force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in the event of maintenance, does not engage the responsibility of the Seller.

The creation of the account implies the acceptance of these general conditions of sale.

Article 4: Payment terms

The price is paid by secure payment, as follows:

• payment by credit card
• or payment by bank transfer to the Seller’s bank account (whose details are communicated to the Customer when placing the order)

The price is payable in cash by the Customer, in full on the day of placing the order.

Payment data is exchanged in encrypted mode thanks to the protocol defined by the authorised payment provider involved in the banking transactions carried out on the https://pro.oraije.com/.

Payments made by the Customer shall be considered final only after actual collection by the Seller of the sums due.

The Seller will not be required to issue the Products ordered by the Customer if the latter does not pay the full price in the above conditions.

Article 5: Deliveries

The Products ordered by the Customer will be delivered in metropolitan France or in the following areas:

Germany, Austria, Belgium, United States, Italy, Luxembourg, Portugal and the United Kingdom.

Deliveries take place within 2 to 7 working days at the address indicated by the Customer (in Metropolitan France) when ordering on the site.

Delivery consists of the transfer to the Customer of physical possession or control of the Product. Except in special cases or unavailability of one or more products, the ordered products will be delivered at once.

The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the deadlines specified above. However, these deadlines are indicative.

If the Products ordered have not been delivered within 5 working days after the indicative delivery date, for any reason other than force majeure or the fact of the Customer, the sale may be resolved at the written request of the Customer under the conditions provided for in articles L216-2, L 216-3 and L241-4 of the Consumer Code. The sums paid by the Customer will then be returned to him at the latest within fourteen days following the date of termination of the contract, to the exclusion of any compensation or withholding.

Deliveries are made by an independent carrier to the address mentioned by the Customer at the time of the order and to which the carrier can easily access.

The Customer is obliged to check the condition of the delivered products. He has a period of 14 days from delivery to make complaints by email, accompanied by all supporting documents (including photos). After this period and failing to comply with these formalities, the Products will be deemed compliant and free of any apparent defect and no claim can be validly accepted by the Seller.

The Seller will refund or replace as soon as possible and at its expense, the delivered Products whose defects of conformity or visible or hidden defects have been duly proven by the Customer, under the conditions provided for in articles L217-4 and following of the Consumer Code and those provided for in these GTCS. The transfer of the risks of loss and deterioration related thereto will only be realized at the time when the Client
